US Court Mandates Freedom of Abrego Garcia from Immigration Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement lacks legal authority.
"Since his return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.
The situation stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to face alien smuggling charges, he was held in immigration custody.
In her decision, the court pointed out that the government lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
